The federal Home Equity Conversion Mortgage (HECM) program sets the bulk of the rules that govern a reverse mortgage: who can borrow, what counseling is required, how the principal limit is calculated, and what happens at maturity. Those rules apply in every state. The 2026 HECM lending limit is $1,249,125 (HUD Mortgagee Letter 2025-22), the federal floor age is 62, and HUD-approved counseling (HUD Handbook 4000.1, Section II.B) is required before any lender can move forward.

What changes state to state is narrower than most aggregator pages imply. The variables worth checking before you apply are:

  • Originator and lender licensing. Every state runs its own mortgage-licensing regime layered on top of NMLS. The agency name and the citation differ; the work the originator does is mostly the same.
  • Recording fees and mortgage taxes. Set at the county or state level. Florida and New York carry the heaviest recording-side costs in the country; most other states are in the tens of dollars.
  • Surviving-spouse protections. Most states default to the federal Mortgagee Optional Election or Eligible Non-Borrowing Spouse framework. A few (New York being the most-cited example) have layered state law on top.
  • Jumbo / proprietary minimum age. Federal HECM is 62 in every state. The private jumbo programs (HomeSafe, Platinum Preserve, SecureEquity+) admit at age 55 in most states but require age 60 in MA, NY, and WA, and age 62 in NC and TX for HomeSafe. See /programs.
  • HUD counselor availability. The HECM Counselor Roster is the authoritative national list. Every state has authorized agencies; most sessions run by phone.
